General Terms and Conditions

1. Preamble

These General Terms and Conditions of Sale (GTC) define the terms and conditions under which Ecoprod, a non-profit association governed by French law (Law 1901), registered under SIRET 90500282000017, with its head office at 9 rue Baudoin, 75013 Paris, offers clients access to online training services in the form of e-learning.

These GTC apply to any person (hereinafter referred to as “the client”) wishing to access or purchase the e-learning training services offered by Ecoprod. By accepting these GTC when purchasing a training course, the client agrees to all the terms and conditions outlined below.


2. Purpose

These General Terms and Conditions of Sale (GTC) aim to govern the contractual relationship between Ecoprod and its clients in the provision of e-learning services. These services mainly consist of access to online training courses.

Access to these training courses is granted upon payment of a defined price for each course, and under the conditions of use specified in these GTC.


3. Acceptance of the GTC

Accepting these GTC is a mandatory prerequisite for purchasing any online training offered by Ecoprod. This acceptance occurs when the order is confirmed on the e-learning platform.

By checking the box “I accept the General Terms and Conditions of Sale”, the client acknowledges having read, understood, and accepted all provisions of these GTC unreservedly.


4. Access to Training Courses

4.1. Account Creation

To access the training courses, the client must create a personal account on Ecoprod’s online platform. Account creation requires the submission of accurate and complete information, including:

  • Full name,
  • A valid email address,
  • A secure password.

The client is solely responsible for maintaining the confidentiality and security of their login credentials. In case of suspected fraudulent use of their account, the client must immediately notify Ecoprod at stepup@ecoprod.com.

4.2. Individual and Personal Access

Access to training courses is strictly personal and non-transferable. Each client has a unique and nominative access. Sharing login credentials with third parties is strictly prohibited.

In case of non-compliance, Ecoprod reserves the right to suspend or close the concerned account without prior notice or refund.

4.3. Access Duration

Access to each training course is limited to a period of 6 months from the date of purchase. After this period, the client will no longer be able to access the content, except in specific cases agreed upon between the parties.


5. Pricing and Payment Terms

5.1. Course Pricing

Training course prices are indicated in euros (€) and are all taxes included (TTC). Internet connection costs required to access the courses are the sole responsibility of the client.

5.2. Payment Methods

Payment is required at the time of purchase. Ecoprod accepts the following payment methods:

  • Credit card via a secure online payment platform,
  • PayPal, a secure electronic payment service.

Ecoprod ensures that all payment transactions are encrypted and secured.

5.3. Full Payment Requirement

The training course must be fully paid before access to the content. No access will be granted without prior payment.


6. Right of Withdrawal

6.1. General Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the client has a 14-day withdrawal period from the contract conclusion date to exercise their right of withdrawal without having to provide a reason.

6.2. Exception to the Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the client expressly waives their right of withdrawal if they access the training content immediately after purchase.

To exercise their right of withdrawal, the client must send an email to stepup@ecoprod.com.


7. Training Course Usage Terms

7.1. Intellectual Property

The training course content (texts, videos, course materials) is protected by intellectual property laws. Consequently, the following actions are strictly prohibited:

  • Copying, reproducing, or distributing the course content,
  • Sharing or selling the content without Ecoprod’s explicit written authorization,
  • Reselling the training courses to third parties without a prior agreement with Ecoprod.

7.2. Usage License

The client benefits from a personal and non-exclusive right of use of the training course content, limited to a period of 6 months. This right does not transfer any intellectual property rights to the client.


8. Ecoprod’s Liability

8.1. Technical Issues

Ecoprod undertakes to take all necessary measures to ensure continuous access to the platform, but cannot be held liable for:

  • Network failures (Internet, service provider issues, etc.),
  • Service interruptions due to technical updates or maintenance,
  • Data loss caused by client or third-party errors.

8.2. Client’s Responsibility

The client is responsible for protecting their login credentials and for the use of their account. Any use of the client’s credentials by a third party is the client’s responsibility.


9. Personal Data and Confidentiality

As part of account management, Ecoprod collects and processes personal data. In accordance with the General Data Protection Regulation (GDPR), Ecoprod ensures data security, confidentiality, and protection.

The purposes of data processing include:

  • Managing training course access,
  • Client support and communication,
  • Tracking user performance.

The client has a right to access, rectify, and delete their personal data. They can exercise these rights by contacting stepup@ecoprod.com.


10. Customer Service

Ecoprod provides its clients with a dedicated customer service for any questions or complaints.


11. Force Majeure

Ecoprod cannot be held liable for any delay or failure to perform its obligations due to a force majeure event, as defined by French legal precedent.


12. Modification of the GTC

Ecoprod reserves the right to modify these GTC at any time. Clients will be informed of these modifications by email or through a website notification.


13. Governing Law and Jurisdiction

These GTC are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before taking legal action.

If no agreement is reached, disputes will be submitted to the competent courts in the jurisdiction of Paris.
